The Maharashtra State chief information commissioner Ratnakara Giakwad under the name of transfers has actually appointed three new information commissioners and cancelled three appointments Of SIC's also .By order no mu.ma.aa/aastha- 2012 -pra.kra 59/01 dated 11 June 2012 he has transferred Bhaskar Patil , sic Amravati to Nagpur , P.W.Patil , sic Nagpur to Nasik , and M.H.Shaha sic Nasik to pune , he has not used word transfer but has given charge of respective posts and relieved them from posts on which they were appointed by Governor .
In Maharashtra , head office of SIC is at Mumbai and as per section 15(7) of RTI act commission after approval of state has established its offices at Pune, Kankan , Brihanmumbai , Amravati, Nasik, Nagpur and Aurangabad .
And Government of Maharashtra by various orders under the name and order of Governor has created posts of officials' including State Information commissioner for each office specifically. And Governor has appointed state information commissions for Amravati, Nagpur and Nasik by separate orders .These appointments are for that specific offices only. My argument is, when Governor appoints SIC for specific post. Then nobody can relieve him from that post unless his term ends, he attains age of 65 years, resigns, or removed from the post of SIC under any of the provision of RTI act.
Its true that CSIC has certain rights regarding general superintendence, direction and management of the affairs of the State Information Commission .But that does mean , he can appoint ,reappoint or relieve the SIC's . In this case all the three SIC's have vacated their offices they were dully appointed on by the governor, and reappointed as SIC's in some other offices. By doing this, I guess he has used Government's and Governor's powers illegally.
Earlier nomenclature of these SIC's was Bhaskar Patil SIC Amaravati,P.W.Patil SIC Nagpur, and M.H.Shaha SIC Nashik now it has changed to Bhaskar Patil SIC Nagpur ,P.W.Patil SIC Nashik , and M.H.Shaha SIC Pune. It would have been different situation if governor had appointed SIC's without specific office names and then CSIC had given them some charge , In that case only CSIC has right to transfer SIC's.
