Deliberate wrong Decisions by the Mrs. Deepak Sandhu Central Information Commission
Mrs. Deepak Sandhu actions for deliberate sabotage of RTI act are as follows.
- Commissioner is returning second appeal (see Note 1for list of sample cases )to First Appellate Authority for decisions, when First Appellate Authority had not made decisions on first appeal before them for six to one year, whose decisions are made in November 2010. (Kindly note as per Proposed New RTI Rules 11 (read Sub rule 2 & 3) , appeal is made after appellant had availed of all the remedies available to him under the Act.(See Relevant Rule As Note 2)
Through this sabotage method ,
Ø Commissioner had delayed the process of getting information.
Ø And increased disposal rate of appeals , which are very low.(See Note 3)
- Commissioner had one of the highest pendency in the Commission. Read with low rate of disposal and very low penalty, it is clear that high pendency and low disposal is deliberate to sabotage the implementation of RTI Act.
- No where in the order rejecting the information request , I found compliance of the Delhi High Court order given in Bhagat Singh Case.. No new exemption is to be created and if there are three conditions for denial , then each one is to be satisfied. No where, Commissioner discusses the Public interest given in the Act inherent in each RTI request and given by the RTI applicant.
Warning: I am not putting any remarks, who had appointed Mrs. Deepak Sandhu Read Prime Minister , DOPT Minister and Leaders of Opposition. In simple words , Mrs Deepak Sandhu
Ø Mrs Deepak Sandhu is not related to Prime Minister , DOPT Minister and Leaders of Opposition
Ø Prime Minister , DOPT Minister and Leaders of Opposition had not given instruction to sabotage the implementation of RTI Act.
Ø Prime Minister , DOPT Minister and Leaders of Opposition did not know the competence (read including incompetence ) of Mrs. Deepak Sandhu , similar to criminal background of CVC (were unknown to PM and HM before appointment) appointed by Prime Minister , Home Minister and Leaders of Opposition
